Insurance Coverage & Litigation

Our attorneys represent insurers in coverage matters involving automobile, homeowners, and commercial insurance policies. Our work includes conducting coverage analysis, coverage opinions and drafting reservation of rights and disclaimers for our clients.

Coverage issues sometimes rise to the level of litigation. Sometimes that is in the form of a declaratory judgment action where a court is asked to help solve the coverage issue. Litigation also arises when an insured makes claims against the insurance carrier arising out of a coverage dispute.

Commercial Insurance Disputes

We understand commercial insurance policies cover and exempt hundreds of people, constantly assessing risk. But businesses and insurers can disagree, which is where experienced lawyers come in. Common disputes can include property insurance claims, commercial liability, breach of contract and hurricane/flood damage.

Insurance Coverage Analysis

If you’re in need of an insurance policy for your business, you need to make sure it will offer all the coverage you need. Common Questions About Insurance Law

Who or what is covered by a policy of insurance?

The total amount of coverage that is available in a given case, as well as an analysis of the
insurance contract, application, or other documents will dictate types and amounts of available insurance.

How much coverage is available?

The coverage levels are usually noted on the Declarations Page, but application of South Carolina law may affect the stated coverage levels.

Does the insurance carrier have an obligation to defend the lawsuit?

The insurance contract and the complaint in the lawsuit determine whether an insurance company must provide a defense to the insured if they are sued. However, there are policy conditions, limitations and exclusions depending on the circumstances which can affect an insurance carrier’s duty to defend an insured.
